Terms of Service

1. Agreement

By accessing or using Property X-Ray (propertyxray.com.au), you agree to these Terms of Service. If you do not agree, do not use the service.

2. The Service

Property X-Ray is a free property research tool that aggregates publicly available government and third-party data for properties in Queensland, Australia. Reports are generated automatically from these datasets.

3. Not Professional Advice

Property X-Ray is provided for general informational purposes only. It does not constitute:

  • Financial advice
  • Legal advice
  • Investment advice
  • Insurance advice
  • Property advice or a property valuation within the meaning of the Property Occupations Act 2014 (QLD)

Reports are not a substitute for professional due diligence. You should independently verify all information with relevant councils, authorities, and qualified professionals (including licensed valuers, solicitors, financial advisers, and building inspectors) before making any property-related decision.

4. Data Accuracy

Report data is sourced from government and public datasets. We do not warrant that any information is complete, current, or accurate. Government data may be updated at different intervals, and there may be delays between when data is published by a source and when it appears in a report.

Specifically:

  • Flood and bushfire overlays reflect mapping data at the time of ingestion and may not account for recent events or remapping
  • Crime statistics reflect reported offences, not convictions, and are subject to reporting lags
  • Price estimates are indicative ranges derived from a statistical model using public land valuations and should not be treated as market appraisals
  • Development application data is sourced from council systems and may not include all applications

5. Third-Party Data Sources

Reports incorporate data from sources including but not limited to: Brisbane City Council, QLD Government, Australian Bureau of Statistics, QLD Police Service, ACARA, NBN Co, TransLink, and OpenStreetMap. This data is subject to the respective licences and terms of those providers. OpenStreetMap data is provided under the Open Data Commons Open Database License (ODbL).

6. Your Account

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information when registering. One account per person.

7. Acceptable Use

You agree not to:

  • Scrape, crawl, or use automated tools to extract data from the service
  • Resell, redistribute, or commercially exploit report data without attribution and appropriate disclaimers
  • Use report data to discriminate against individuals or communities
  • Interfere with the operation of the service
  • Misrepresent report data as professional advice, a formal valuation, or an official government document

8. Intellectual Property

The report format, layout, scoring methodologies, and AI-generated analysis are owned by Property X-Ray. The underlying government and public data incorporated into reports remains subject to its original licensing. You may share reports using the built-in share link feature.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Property X-Ray is not liable for any loss or damage arising from your use of, or reliance on, any information in a report
  • Property X-Ray is not liable for any indirect, consequential, or incidental damages
  • Property X-Ray does not guarantee uninterrupted or error-free service

Nothing in these terms excludes or limits consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by law.

10. Indemnity

You agree to indemnify Property X-Ray against any claims, losses, or expenses arising from:

  • Your use of report data as professional advice or a formal property valuation
  • Your redistribution of report data without appropriate disclaimers
  • Your breach of these terms

11. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.

12. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the service after changes are posted constitutes acceptance of the updated terms.
